All copyright in the Test Reports issued by TÜV SÜD PSB Pte Ltd – Testing Group (“TÜV SÜD PSB - Testing Group”) shall remain with TÜV SÜD PSB - Testing Group. The Test Report issued is subject to the terms and conditions specified herein and in the TÜV SÜD PSB - Testing Group’s terms and conditions governing product testing, inspection and certification services provided by TÜV SÜD PSB - Testing Group and on the report.
The Test Reports published herein shall not be reproduced wholly or in parts and no reference shall be made to TÜV SÜD PSB - Testing Group or to the Test Report or results therein in any advertisements or sales promotions.
Unless otherwise stated, the Test Report shall contain only technical results.
The Test Report applies to the sample of the specific product / equipment provided to TÜV SÜD PSB - Testing Group at the time of its testing / calibration. The results contained in the Test Report are not to be used to indicate or imply that they are applicable to other similar items.
The sample/s referred to in the Test Report is/are submitted, supplied or manufactured by the party requesting for the testing services. TÜV SÜD PSB - Testing Group assumes no responsibility for the accuracy of information in respect of the brand name, model number, origin of manufacture, consignment or any other information supplied in respect of the sample provided.
Nothing in the Test Report shall be interpreted or construed to mean that TÜV SÜD PSB - Testing Group has verified any endorsements or marks from any other testing authority or bodies that may be found on the sample provided and TÜV SÜD PSB - Testing Group does not make any representation or gives any guarantee or warranty regarding such endorsements or marks.
THE RESULTS IN THE TEST REPORT DO NOT INDICATE OR IMPLY THAT TÜV SÜD PSB - TESTING GROUP IN ANY WAY APPROVES, RECOMMENDS OR ENDORSES THE MANUFACTURER, SUPPLIER OR USER OF SUCH PRODUCT / EQUIPMENT.
TÜV SÜD PSB - TESTING GROUP DOES NOT IN ANY WAY GIVE ANY GUARANTEE OR WARRANTY IN RESPECT OF THE INFORMATION CONTAINED IN THE TEST REPORT OR THE PERFORMANCE OR CAPABILITIES OF THE PRODUCT / EQUIPMENT. ALL WARRANTIES OF ANY KIND, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ARE HEREBY EXPRESSLY EXCLUDED.
IN NO EVENT SHALL TÜV SÜD PSB PTE LTD, ITS EMPLOYEES AND AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE TEST REPORTS OR FOR ANY INFORMATION CONTAINED IN THE TEST REPORTS WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE AND WHETHER OR NOT TÜV SÜD PSB PTE LTD WAS OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY THAT SUCH DAMAGE OR LOSS COULD OCCUR.
